These policies are designed to comply with New Zealand law, including the Privacy Act 2020 (as amended by the Privacy Amendment Act 2025), the Fair Trading Act 1986, the Consumer Guarantees Act 1993, the Unsolicited Electronic Messages Act 2007, and the Contract and Commercial Law Act 2017.


1. Website Terms and Conditions

1.1 Introduction

These Terms apply to your use of the Website only. Any vehicle hire is governed by a separate Rental Agreement entered into at the time of booking or pickup. In the event of any inconsistency between these Terms and the Rental Agreement in relation to a vehicle hire, the Rental Agreement prevails.

1.2 Eligibility to use the Website

By using the Website, you confirm that you are at least 18 years old (or have parental/guardian consent) and have the legal capacity to enter into a binding contract under New Zealand law.

1.4 Acceptance of Terms

Your continued use of the Website constitutes acceptance of these Terms. We may amend these Terms at any time by posting an updated version on the Website. The "Last updated" date at the top of these Terms reflects the most recent revision. Material changes will be notified by reasonable means (such as a notice on the Website). Continued use after changes take effect constitutes acceptance of the amended Terms.

1.5 Use of the Website

You agree to use the Website only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of the Website. In particular, you must not:

  • use the Website in any way that breaches any applicable New Zealand or international law or regulation;
  • use the Website to transmit or send unsolicited commercial communications;
  • attempt to gain unauthorised access to the Website, the server on which it is stored, or any connected server, computer, or database;
  • introduce viruses, trojans, worms, logic bombs, or other malicious or harmful material;
  • attack the Website via a denial-of-service attack or distributed denial-of-service attack;
  • use any automated system (including robots, spiders, scrapers, or similar) to access the Website except for legitimate search engine indexing;
  • copy, reproduce, republish, distribute, or commercially exploit any content from the Website without our prior written consent; or
  • impersonate any person or entity, or misrepresent your affiliation with any person or entity.

1.6 Bookings and reservations

The Website allows you to search for, view, and book rental vehicles. Any booking made through the Website:

  • is an offer by you to hire a vehicle on the terms specified;
  • is subject to availability and our acceptance;
  • becomes a binding contract only when we issue a confirmation;
  • is governed by our Rental Agreement (available at bluedotrentals.co.nz/rental-agreement) and any additional terms communicated at the time of booking; and
  • may be subject to a deposit, security hold, or pre-authorisation on your payment card.

We reserve the right to refuse, cancel, or modify any booking at our reasonable discretion, including where:

  • the vehicle is unavailable due to mechanical issues, accident, or prior non-return;
  • there has been an obvious pricing or descriptive error;
  • the booking does not meet our driver eligibility requirements; or
  • we have reasonable grounds to suspect fraud, misuse, or breach of these Terms or the Rental Agreement.

If we cancel a confirmed booking for reasons within our control, we will refund any amount paid, in line with the Rental Agreement and the Consumer Guarantees Act 1993.

1.7 Pricing, taxes, and payment

All prices on the Website are displayed in New Zealand Dollars (NZD) and, unless stated otherwise, include GST at the prevailing rate.

Prices, fees, and availability are subject to change without notice until a booking is confirmed. We take care to ensure pricing accuracy, but we reserve the right to correct obvious errors and, where a price is clearly incorrect, to cancel any booking made on the basis of that error and refund any amount paid.

Payment is processed via secure third-party providers. By submitting payment information through the Website, you confirm that you are authorised to use the payment method and authorise us (and our payment providers) to charge the applicable amounts.

1.8 Accuracy of information

We make reasonable efforts to ensure the information on the Website is accurate and up to date. However, the Website is provided on an "as is" and "as available" basis. To the extent permitted by law, we do not warrant that:

  • the Website will be uninterrupted, error-free, or free of viruses or other harmful components;
  • the content on the Website (including vehicle specifications, images, prices, and availability) is complete, current, or accurate at all times; or
  • defects will be corrected.

Vehicle images on the Website are for illustrative purposes only. The actual vehicle supplied will be of the make, model, or type booked, but specific colour, model year, or features may vary.

1.9 Intellectual property

All content on the Website — including logos, trade marks, text, graphics, photographs, vehicle imagery, software, and design — is owned by or licensed to Blue Dot Rentals and is protected by New Zealand and international copyright, trade mark, and other intellectual property laws.

You may view, download, and print content from the Website for personal, non-commercial use only. You must not otherwise reproduce, modify, distribute, transmit, display, or create derivative works from any content without our prior written consent.

The "Blue Dot Rentals" name, logo, and brand colours are our trade marks and may not be used without our written permission.

1.10 Third-party links and content

The Website may contain links to third-party websites, services, or partners (including but not limited to our Accommodation Partners, Coast Towing, GRI Education, and others listed under "Our Partners"). These links are provided for your convenience only.

We do not control, endorse, or assume responsibility for the content, privacy practices, or operations of any third-party site. Your use of any third-party site is at your own risk and subject to that site's terms and privacy policies.

1.11 User-submitted content

If you submit any content to the Website (such as reviews, enquiries, comments, or feedback), you:

  • warrant that the content is accurate, lawful, and does not infringe any third party's rights;
  • grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, modify, and publish the content for purposes connected with our business; and
  • acknowledge we may remove or edit any content at our discretion.

1.12 Consumer Guarantees Act 1993

Where you acquire services from us as a consumer for personal, domestic, or household purposes, you have rights under the Consumer Guarantees Act 1993 (CGA) and the Fair Trading Act 1986. Nothing in these Terms is intended to limit, exclude, or modify those rights to the extent they cannot lawfully be limited, excluded, or modified.

If you acquire services from us for the purposes of a business, you agree that the CGA does not apply to that supply, in accordance with section 43 of the Act.

1.13 Limitation of liability

To the maximum extent permitted by law, and subject to clause 1.12:

  • we exclude all warranties, representations, and conditions (express or implied) other than those that cannot lawfully be excluded;
  • we are not liable for any indirect, consequential, special, or punitive loss (including loss of profit, loss of business, loss of data, or loss of opportunity) arising from your use of the Website; and
  • our total aggregate liability to you for all claims arising in connection with the Website (other than claims relating to a confirmed vehicle booking, which are governed by the Rental Agreement) is limited to NZD $100.

Nothing in this clause limits liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited under New Zealand law.

1.14 Indemnity

You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and expenses (including reasonable legal costs) arising from:

  • your breach of these Terms;
  • your misuse of the Website; or
  • your violation of any law or third-party rights in connection with your use of the Website.

1.15 Suspension and termination

We may suspend or terminate your access to the Website (in whole or in part) at any time, with or without notice, if:

  • you breach these Terms;
  • we are required to do so by law; or
  • we discontinue the Website or any feature.

Termination does not affect any rights or obligations that have accrued before termination.

1.16 Force majeure

We are not liable for any failure or delay in performance under these Terms caused by events beyond our reasonable control, including natural disasters, earthquakes, severe weather, pandemics, government action, civil unrest, or failures of telecommunications or utility services.

1.17 Governing law and jurisdiction

These Terms are governed by New Zealand law. You and we submit to the non-exclusive jurisdiction of the New Zealand courts in relation to any dispute arising out of or in connection with these Terms or the Website.

1.18 Disputes

If you have a complaint about the Website, please contact us first at info@bluedotrentals.co.nz and we will work in good faith to resolve it.

If we cannot resolve a dispute, you may have rights to pursue resolution through:

  • the Disputes Tribunal (for claims up to NZD $30,000);
  • the Commerce Commission (for Fair Trading Act issues);
  • the Office of the Privacy Commissioner (for privacy issues); or
  • the Motor Vehicle Disputes Tribunal (for issues within its jurisdiction).

1.19 General

  • Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force.
  • No waiver: Failure to enforce any provision is not a waiver of our right to enforce it later.
  • Entire agreement: These Terms (together with the Privacy Policy, Cookie Policy, and any Rental Agreement) constitute the entire agreement between you and us regarding the Website.
  • Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights to any successor of our business.

2. Privacy Policy

2.1 Introduction

Blue Dot Rentals ("we", "us", or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, store, disclose, and protect your personal information in accordance with the Privacy Act 2020 (as amended by the Privacy Amendment Act 2025) and the thirteen Information Privacy Principles (IPPs).

This Privacy Policy applies to personal information collected through bluedotrentals.co.nz, in person at our branches, by phone or email, and through any related service.

2.2 What is personal information?

Personal information is any information about an identifiable individual. It includes obvious identifiers like name and contact details, and may include things like driver's licence numbers, payment information, IP addresses, and location data when linked to you.

2.3 Information we collect

We collect personal information that is necessary for our lawful business purposes. This may include:

Identity and contact information:

  • Full name, date of birth
  • Email address, phone number
  • Residential and billing address
  • Country of residence

Driver and licensing information:

  • Driver's licence details (number, country of issue, expiry, classes)
  • International Driving Permit (where applicable)
  • Driving history relevant to rental eligibility

Booking and payment information:

  • Booking details (pickup/drop-off location, dates, vehicle preferences)
  • Payment card details (processed by our payment providers — we do not store full card numbers)
  • Security deposit and pre-authorisation records
  • Records of additional drivers

Operational and safety information:

  • Vehicle telematics and GPS data (location, speed, distance, route history) from our fleet tracking system, while you are using a rental vehicle
  • Toll, traffic infringement, and parking notice records
  • Incident, damage, and accident reports

Website and communications data:

  • IP address, device identifiers, browser type, operating system
  • Pages visited, time on site, referring URL
  • Cookies and similar technologies (see our Cookie Policy)
  • Records of correspondence with us (email, phone, in-person notes, contact form submissions)

Marketing preferences:

  • Subscription status and preferences
  • Records of consent given or withdrawn

2.4 How we collect information

We collect personal information:

  • Directly from you — when you make a booking, create an account, contact us, complete a form, sign a Rental Agreement, or interact with our staff;
  • From your use of our services — including telematics from rental vehicles, website analytics, and CCTV at our branch locations (signposted where in use); and
  • From third parties — including travel agency referral partners, accommodation partners, payment processors, fraud prevention services, NZTA and equivalent overseas registration authorities, toll operators (such as NZTA Tolling and Linkt), insurance providers, and (where lawful) credit reporting agencies.

In line with Information Privacy Principle 3A (in force from 1 May 2026), where we collect personal information about you from a source other than you (for example, a referral partner), we will take reasonable steps to ensure you are aware that this collection has occurred, the purposes of collection, and the other matters required by IPP 3.

2.5 Why we collect and use your information

We collect, hold, and use your personal information for the following purposes:

  • to process bookings, take payments, and provide rental vehicles and related services;
  • to verify your identity, driver eligibility, and entitlement to drive in New Zealand or Australia;
  • to manage our fleet, including locating, tracking, and recovering vehicles;
  • to investigate and respond to accidents, damage, traffic infringements, tolls, and insurance claims;
  • to prevent, detect, and investigate fraud and unauthorised use;
  • to comply with our legal obligations under New Zealand and Australian law (including land transport, tax, anti-money laundering, and consumer law);
  • to communicate with you about your booking and our services;
  • to send marketing communications where you have consented (you can opt out at any time);
  • to improve our services, website, and customer experience through analytics; and
  • to enforce our Rental Agreement and these Terms, and to establish, exercise, or defend legal claims.

We will not use your personal information for purposes unrelated to those listed above without your consent, except where permitted or required by law.

2.6 Disclosure of your information

We may disclose your personal information to:

  • Service providers and partners that help us operate our business, including IT and hosting providers, payment processors (e.g., Stripe, BlinkPay), fleet tracking and telematics providers, customer communication platforms, accounting providers, and our travel agency referral partners;
  • Insurance providers and brokers, in connection with your rental and any claim;
  • Government agencies and law enforcement, including NZ Police, NZTA, the Inland Revenue Department, the Commerce Commission, and equivalent Australian authorities, where required or authorised by law;
  • Toll operators and traffic authorities, where you incur tolls or infringements during your rental;
  • Debt collection agencies and credit reporting bodies, where amounts remain unpaid;
  • Professional advisers such as our lawyers, auditors, and accountants;
  • Purchasers of all or part of our business, in connection with any actual or proposed sale or restructure (subject to appropriate confidentiality protections); and
  • Any other party with your consent or as otherwise permitted by the Privacy Act 2020.

2.7 Overseas disclosure

Some of our service providers and our Australian operations may store or process personal information outside New Zealand, including in Australia, the United States, the European Union, and other jurisdictions where our suppliers operate.

In line with Information Privacy Principle 12, before disclosing personal information overseas, we take reasonable steps to ensure the recipient is subject to comparable safeguards to those under the Privacy Act 2020 — for example, by using contractual protections, relying on jurisdictions prescribed under the Act, or obtaining your consent.

2.8 Security and storage

We hold personal information in a combination of secure electronic systems and physical files at our branches. We take reasonable steps to protect personal information from loss, misuse, unauthorised access, modification, or disclosure, including through:

  • access controls and authentication on our systems;
  • encryption of data in transit (TLS) and where appropriate at rest;
  • staff training on privacy obligations;
  • secure disposal of records when no longer needed; and
  • contracts requiring our service providers to maintain appropriate security.

No system is completely secure. If we become aware of a privacy breach that has caused or is likely to cause serious harm, we will notify the affected individuals and the Office of the Privacy Commissioner as required by Part 6 of the Privacy Act 2020.

2.9 How long we keep your information

We retain personal information only for as long as necessary for the purposes for which it was collected, including:

  • to provide our services and manage your bookings;
  • to comply with our legal obligations (for example, at least 7 years for tax records under the Tax Administration Act 1994);
  • to resolve disputes, defend claims, and pursue unpaid amounts; and
  • to retain accident, damage, infringement, and toll records for the limitation periods that apply to those matters.

When personal information is no longer required, we securely delete or de-identify it.

2.10 Your rights

Under the Privacy Act 2020 you have the right to:

  • Access the personal information we hold about you;
  • Correct information that is inaccurate, incomplete, misleading, or out of date;
  • Withdraw consent to marketing communications at any time (using the unsubscribe link in our emails or by contacting us);
  • Make a complaint to us about how we have handled your personal information; and
  • Make a complaint to the Office of the Privacy Commissioner if you believe we have breached the Privacy Act.

We will respond to access and correction requests within 20 working days, as required by the Act. Where we cannot provide access (for example, where doing so would breach another person's privacy), we will explain the reason.

To exercise your rights, please contact our Privacy Officer (see clause 2.13).

2.11 Marketing communications

We will only send you marketing communications where we are permitted to do so under the Unsolicited Electronic Messages Act 2007. Every marketing email we send will identify us, identify how to contact us, and contain a working unsubscribe link.

You can opt out of marketing communications at any time without affecting our provision of rental services to you.

2.12 Children

Our services are not directed at children under 18, and we do not knowingly collect personal information from children. If you believe we hold information about a person under 18 without appropriate authority, please contact us so we can delete it.

3. Cookie Policy

3.1 Introduction

This Cookie Policy explains how Blue Dot Rentals uses cookies and similar technologies on bluedotrentals.co.nz. It should be read together with our Privacy Policy.

3.2 What are cookies?

Cookies are small text files stored on your device when you visit a website. They are widely used to make websites work, improve user experience, and provide information to website owners.
