Rental agreement

This Rental Agreement is made between BluedotRentals.co.nz ("Company") and the customer specified in the Rental Document ("Renter"). By signing this agreement, the Renter agrees to the terms and conditions outlined below:

1. Vehicle Description

The Company agrees to rent the motor vehicle described in the Rental Document to the Renter for the specified hire period.

2. Hire Period

The Renter agrees to hire the vehicle from the date and time specified in the Rental Document ("Hire Start") and return it by the agreed date and time ("Hire End"). Failure to return the vehicle on time may result in additional charges as described below.

3. Authorized Drivers

Only individuals listed in the Rental Document, holding a valid full driver’s license, may operate the vehicle. Additional drivers must be declared at the time of signing the rental agreement. The Renter is responsible for ensuring compliance with all New Zealand road laws.

4. Rental Charges

 Rental charges are based on a daily rate, with each day comprising a 24-hour period starting from the Hire Start time. The Renter must pay all rental charges as specified in the Rental Document, including any applicable Goods and Services Tax (GST). Charges for additional services (e.g., excess kilometers, fuel, tolls) will apply as per the terms set forth in this agreement.

5. Fuel

The Renter is responsible for refueling the vehicle to the same level as provided at the time of rental. If the vehicle is returned with less fuel, the Company will charge the Renter a $40 service fee plus the cost of fuel and the applicable GST. No refunds can be issued for over fueling.

6. Return of Vehicle

The vehicle must be returned by the Hire End time to the location specified in the Rental Document. If the vehicle is not returned to the agreed location, the Renter is liable to pay a recovery fee ranging from $400 to $3,000 depending on the distance and the conditions of retrieval. Late returns will also incur additional daily rental charges and any applicable fees.

7. Insurance & Liability

The Renter is responsible for:

(i) Any loss or damage to the vehicle, its accessories, and spare parts during the hire period.

(ii) Any loss of, or damage to, vehicles and property of third parties during the hire period arising from the use or misuse of the vehicle.

(iii) Any consequential damage, loss, or costs, including salvage costs, loss of ability to rehire, and loss of revenue, incurred by the Company in connection with the Renter’s use or misuse of the vehicle.

The Renter agrees to release and indemnify the Company from and against all actions, claims, demands, losses, damages, costs, and expenses resulting from the use or misuse of the vehicle. The Company may end the rental and recover the vehicle if it is damaged by the Renter.

8. Unpaid Tolls, Parking, and Other Fines

If the Renter incurs any toll charges, parking violations, or other fines during the rental period, they are responsible for paying these charges. If the Company is required to process unpaid tolls, parking violations, or other fines on behalf of the Renter, a $40 administration fee will be applied for each violation or fine in addition to the cost of the fine itself.

9. Pre-Authorization and Deposit (Security Bond)

A pre-authorization for a refundable deposit stated above will be required on a credit card prior to the rental period. This amount will be held for the duration of the rental and refunded upon the safe return of the vehicle, subject to the terms of this agreement.

The Renter acknowledges that the rental bond (security bond) may take up to 5 business days to be returned after the safe return of the vehicle. The bond will only be processed for return after an inspection by a Company employee to ensure the vehicle is in its original condition, subject to the terms of this agreement.

10. GPS Tracking

The vehicle will be GPS-tracked for the duration of the rental period. Any tampering, removal, or interference with the GPS tracking system is strictly prohibited. The Renter is liable for any damage or loss caused by tampering with the GPS system.

11. Damage, Repairs, and Maintenance

The Renter must notify the Company immediately if the vehicle is involved in an accident or suffers damage. No repairs should be undertaken without the Company’s prior written consent, except in emergencies to prevent further damage. The Company is responsible for ensuring that the vehicle is roadworthy at the start of the hire period.

12. Renter’s Obligations

The Renter agrees to:

 (i) Take all reasonable precautions to secure and care for the vehicle.

(ii) Ensure the vehicle is operated in a safe and lawful manner.

13. Cleaning & Additional Fees

The vehicle must be returned in a clean and tidy condition. The Company reserves the right to charge a cleaning fee for vehicles returned in an excessively dirty condition. The Renter will be liable for the cost of replacing any lost keys, toll charges, or damage caused by improper use of the vehicle.

14. Cancellation Policy

The Company reserves the right to cancel the agreement if the renter fails to comply with any terms of this agreement or if the vehicle is damaged, lost, or involved in an accident. Additionally, the Company reserves the right to cancel the booking in the event of unforeseen circumstances beyond its control.

15. Use Restrictions

The vehicle must not be:

Used for commercial transport of passengers or goods without written consent.

Driven outside the permitted areas as specified by the Company.

Used to transport dangerous goods or animals during the rental period.

Driven by individuals not listed in the Rental Document.

16. Privacy Statement

The Renter’s personal information will be used solely for the purposes of this Rental Agreement and related services, including any necessary third-party disclosure for insurance, tolls, or fines. The Company will comply with its obligations under the Privacy Act 2020, which limits its rights to collect, use, and store such information. The Renter’s information will not be shared without consent, except as required by law.

17. Dispute Resolution

In the event of a dispute arising from this agreement, the Renter agrees to first contact the Company directly to seek a resolution before involving third-party agencies or financial institutions.

18. Agreed Excess Liability In the event of an incident involving the rental vehicle, the renter shall be liable for an amount up to the agreed excess as specified in the rental agreement. This excess amount represents the maximum financial responsibility of the renter for any damage or loss, subject to the terms and conditions of this agreement. The agreed excess applies unless otherwise reduced or waived under a purchased insurance or protection plan.
